A cogent take on today’s much ballyhooed announcement (which shouldn’t really be a surprise to anybody). Still, like others, I’m mulling whether the verdict means that there is a lawful precedent for liability when linking to copyrighted content (which is something pretty much all search engines do). I’m betting that the entertainment industry, being the poster child for hyperbole, will take that, run with it, and proceed to attempt to establish that even mentioning copyrighted content is illegal, since the current definition of “fair use” never sat well with them and that linking is, after all, a sort of reference. And isn’t mentioning content a reference? My, what tangled webs we weave.
